Why should I cooperate with a debt recovery agency?
By cooperating honestly with a debt recovery agency, the debtor may avoid incurring the additional costs of court and bailiff proceedings and having their name put on the debtors register. It is possible to arrange a debt repayment plan which will not make the debtor's situation more difficult.
Why do I owe debt to GPM “Vindexus” S.A.?
Under Article 509 § 1 Civil Code, debt can be transferred to another entity based on an assignment agreement. The new creditor acquires all rights, including the right to claim interest and the right to security that was originally vested with the entity which sold the debt. If you receive a request for payment from GPM "Vindexus” S.A., this means that a debt collection agency is your creditor now.
Should I provide my personal data when talking with a GPM „Vindexus” S.A. representative?
Yes. Based on your personal data, a Vindexus employee may verify whether they are speaking to the right person. Please provide your first and last name, as well as your PESEL number and your customer number that can be found on the letter we sent you. We are the Controller of your personal data pursuant to the Personal Data Protection Act of 1997 (consolidated text, Journal of Laws 2002, No. 101, item 926), which provides protection for your data. Your personal data will not be used by the Company for marketing purposes or processed contrary to the provisions of the Act.
How do I make a repayment and how is the amount determined?
The correct account number and the balance due are indicated in the letter you received; it can also be found on our website. To find out where your debt comes from, how it was calculated and to ask any other questions you may have, please contact GPM Vindexus S.A.
What happens if debt is not repaid?
Failure to repay debt and to contact GPM "Vindexus” S.A. will result in court and bailiff proceedings being initiated, which in turn will generate additional costs for the debtor. Amicable resolution of the case is in the best interest of the company and the debtor.
What is amicable debt recovery?
Amicable (non-contentious) debt recovery involves a settlement agreement under which the creditor and the debtor determine the amount of debt and the repayment method without the participation of other bodies, including the court or a bailiff; this helps to avoid enforcement proceedings against the debtor’s property.
How are court and bailiff fees determined?
The manner in which court and enforcement-related costs are determined and their amount are defined in the relevant provisions of law, in particular the Act of 28 July 2005 on court fees in civil proceedings. Such costs, payable by the debtor to the creditor, are awarded by the court or a bailiff. The above-mentioned costs are totalled up and have to be paid by the debtor. As a result, if the debtor fails to cooperate, their debt may increase significantly.
What was the basis for putting my name on the debtor’s register?
Personal data of a debtor may be registered with the National Debtors Register based on the Act on sharing and exchange of economic data (Journal of Laws 2010, no. 81, item 530).
What happens when my personal details are put on the debtors’ register?
Registration of a debtor’s personal data in the National Debtors’ Register or another Economic Information Bureau serves as a warning to other parties, especially banks and telecommunications operators, that a customer may be unreliable. Where information concerning your debt is put on the National Debtor's Register, this may restrict the activities you may take on the consumer market or your business activity for up to 10 years. Banks, lease companies, financial intermediaries, telecommunications operators, cable TV companies and many other organisations may not want to work with you or may offer you their services on less favourable terms.
